1. Purpose and general issues
By contracting through this website with Fundación Cudeca, you will acquire our products (detailed in the corresponding section of the website) for a certain price, which is also detailed on the page.
These general contracting conditions regulate the acquisition, through the website https:// joanbycudeca .org// regarding the products offered therein.
The ownership of the website and other general data are indicated in the "Legal notice" tab, which we recommend you always consult before contracting.
To contract through the web, you must fill in the forms for this purpose and accept these General Conditions, without reservation. The contracting procedure is detailed step by step on the website itself, once the product has been chosen, and consists of:
1st. Choose the product of your interest, marking on it.
2nd. Check once there its characteristics and prices.
3rd. Select the product with the "ADD TO CART" button.
4th. You must enter the personal data required to process your request, making sure they are correct. You can also register to expedite your next purchases.
5th. Verify that you are not mistaken in choosing the product in question, that your personal data is accurate, check the shipping costs, if any, the price, etc.
6th. You will directly access the payment gateway section.
7th. Payment confirmation: You will receive an email at the address you provide us with all the information, in relation to the contracted product, and the order confirmation and your payment.

2. Ability to contract
The client, when contracting, acknowledges that he is of legal age and that he has sufficient legal capacity to be bound by these general conditions.

You are responsible for the veracity of the data entered and that it is yours and not that of third parties.

4. Shipping and delivery conditions
We send all our products with a 24/48h courier service, the company collects the packages in our warehouse at 2:00 p.m., so if you order after 12:00 p.m. it will be shipped the next day.
If you need to know where your package is at all times, the transport company will send you an SMS and an email so that you can track your order.

- Orders over €30 ➝ FREE
In case a package is returned UNDELIVERED a cost of €8 will be applied. This includes the cost of shipping back to our warehouse and the cost of the new shipment. A free shipping coupon will then be sent to offset the cost of a new order.
In the case of cancellation of the order, once it has been returned, the price of the two shipments (€7.80) will be deducted from the amount.
In the event that a package is returned UNDELIVERED In the Balearic Islands or Portugal the procedure will be the same using the price of the shipments as a basis.
At Fundación Cudeca we try at all times to keep the information related to stock updated, therefore, if a product is out of stock, it will normally be notified before the order is confirmed. If for any reason such prior notification is not possible, you agree to communicate it as soon as possible.
Given this eventuality, the client will have the right to totally or partially cancel the order, and to reimburse the corresponding amount.
5. Prices
Simply browsing this website is completely free.
The price of each product and the detail of taxes and shipping costs (if any) are indicated on the website itself, in the corresponding section of each product or service, or they will be set by mutual agreement with the user by any reliable means.
The prices will be paid at the time of confirming the contract by the client.
Fundación Cudeca guarantees the price established on the day the contract was made.
Fundación Cudeca can unilaterally modify the prices of the products on its website, in any case and without prior notice, as well as suspend or cancel its offer temporarily or permanently.
The validity of the offers will have the character that is established on the web.
6. Withdrawal and Return
You have the right to withdraw from this contract within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days from the day you or a third party authorized by you, other than the carrier, acquired material possession of the goods.
Standard return:
If any garment is not what you expected, you must send it to us in such a way that it reaches us within 14 days from when you received the order.
As soon as we receive it, we will examine it and return the money to your bank account.
Return for damages:
The free return for damages will be available as long as the garment presents some important aesthetic damage that is not detailed in its condition or description and that is not visible in the photographs. It is only available if we ship the return and in this case the money will be returned in a voucher.
Return conditions:
Before making a return shipment, write to us so that we can manage it better, preferably via Instagram or the phone number that appears on the shipment and we will reply to you as soon as possible (usually the same day). If a package appears unannounced at the door, we will not be able to refund your money.
For the return to be valid we have to receive the package within 14 days from when the order arrived.
The garment must be in the condition in which you received it.
Return process:
- Notify us of the return by email to the address shoponline@cudeca.org
- Send it by mail to the address Av. de José Ortega y Gasset, 246a, 29006 Málaga
- For the return to be valid, the product must come in the same box in which you received it, protected by some outer wrapper. If the package is not wrapped or the box arrives wrapped in adhesive tape, an extra charge of €2 will be applied.
- IMPORTANT: Put a piece of paper inside the package where it reads:
- The name with which you placed the order and order number
- The email with which you contacted us.
- The payment method you used.
- If you would like to receive the refund in your account or in a voucher with a discount of €2 for your next purchase.
If we receive a package without point d, the return will be stopped until you contact us.
Order cancellation:
In the case of canceling an order that has not yet left our warehouse, the total amount will be refunded less the commission for processing the payment platform.
7. Method of Payment
Payment for purchases is made by Visa or PayPal payment card. The accepted payment cards are: Visa, Visa Electron, MasterCard and American Express. It will be the customer's responsibility to save and print their bank transfer if they wish to retain their bank and transaction details.
In the event that a customer is improperly charged for the amount of a purchase, without the identification of the corresponding bank card having been verified by cudecashop.com, the customer may demand the immediate cancellation of the charge by sending an e-mail, and the refund of the amount improperly debited must occur within a maximum period of 8 days if the customer used a debit card or PayPal and, before the end of the corresponding month, if the payment was made by credit card. However, in the event that the purchase has actually been made by the client who demands the cancellation of the charge, he must compensate cudecashop.com for the damages caused by said cancellation.
8. Applicable law and jurisdiction
These General Conditions are governed by Spanish law. To resolve any controversy or conflict that may arise, the consumer expressly submits to the courts of Malaga.
